Expansion of the Consumer Data Right Rules to the Telecommunications Sector
Communications Alliance has made a submission in response to the proposed amendments to the Competition and Consumer (Consumer Data Right) Rules 2020. The submission:
Notes that the data definitions should be further refined, so there is adequate guidance in the standards setting process;
- Sets out concerns around the definitions of 'usage data' and ‘metadata’ and suggests how they could be more clearly defined;
- Outlines the lack of clarity around the term ‘publicly offered’ products in relation to business and enterprise products, and requests a revision to the Explanatory Materials to exclude them;
- Requests more detail about how the dispute resolution process will work in practice;
- Recommends that hardship information should be expressly excluded from account data; and
- Requests a phased implementation for the telecommunications sector and 24 months for Trache 1 to comply.
CA Submission - CDR Action Initiation
Communications Alliance has made a submission in response to the exposure draft legislation to enable action initiation under the Consumer Data Right.
The draft legislation amends the Competition and Consumer Act 2010 and introduces ‘action initiation’ reforms, which would enable CDR consumers to direct accredited persons to send instructions to initiate actions on their behalf.
The Communications Alliance raises three high level concerns, being:
- The number of CDR consultations that are occurring.
- The questionable benefit of action initiation for telecommunications consumers, given the existing well-established processes for consumers to access information and switch between providers.
- The need to ensure security in relation to CDR data and ensure the action initiation obligations do not override the security obligations already in place in the telecommunications sector.
