Consumer Data Right in the Telecommunications Sector

Background:

The Consumer Data Right (CDR) legislation, passed by Federal Parliament in August, aims to provide greater choice and control for Australians over how their data is used and disclosed. It will allow consumers to access particular data in a usable form and to direct a business to securely transfer those data to an accredited data recipient – making it easier for other providers of the same service to compete for an individual’s business.

Banking is the first sector to implement the CDR in Australia, with launch expected in early 2020.

Telco will soon be asked to implement the CDR, with major implications for every CSP in Australia.

What will be expected of industry? Does telco have to implement in the same way as the banks? What are the implications for data management, privacy and competition?

TCP Code 2019: Deep dive webinar

Communications Alliance will be hosting a webinar to provide detailed information and answer RSP questions on the revised TCP Code, which comes into effect on 1 August.

The ACMA will also present on their compliance and enforcement priorities, and Communications Compliance will join to discuss Code obligations and attestation.

Background:

This Communications Alliance Comms Essentials seminar will present an overview of the important new revisions to the Telecommunications Consumer Protections (TCP) Code.

The TCP Code was revised by an independently chaired Communications Alliance working committee consisting of representatives from industry, consumers, government, and regulators in an 18-month project. It was then submitted to the ACMA for registration by Communications Alliance. The ACMA is considering registration, following which RSPs will have one month to become compliant with the new Code.

The revised TCP Code will be published upon registration, prior to the Comms Essentials.

This seminar will provide an overview of key revisions to the Code and information on associated compliance and enforcement activities, including presentations from the ACMA and Communications Compliance. It will address key themes of consumer protection, and we will also invite questions and discussion.

Communications Alliance will also host, at a later date, a longer webinar to delve into the detailed changes and offer an opportunity to address specific questions from RSPs.

Please note: We will confirm this event with all registered guests – or notify them of cancellation if needed – on Friday 28 June, as it is dependent upon the registration of the Code by the ACMA.

Assistance and Access Act 2018 (Encryption Bill) Forum

On 6 December 2018, the Telecommunications and Other Legislation Amendments (Assistance and Access) Act 2018 was passed in both Houses of Parliament after Labor had withdrawn a number of suggested amendments in return for Government’s promise to review the Act and consider the amendments in the New Year. The PJCIS is currently reviewing the legislation and is tasked to produce a report by 4 April 2019.

A collective of Industry Groups, including Communications Alliance, the Australian Industry Group(Ai Group), the Australian Information Industry Association (AIIA), the Australian Mobile Telecommunications Association, Digital Industry Group Inc (DIGI) and the Information Technology Professionals Association (ITPA) has recently made a submission to the PJCIS, recommending a raft of changes, drawing on the expertise of its members and recommending incorporation of the most useful aspects of the Labor amendments.

This Forum will provide an overview over the recommended changes to the legislation followed by observations from an expert panel, Q & A and discussion.
