Information Session

Update against industry outcomes arising from the Communications Legislation Amendment (Content Services) Act 2007

This information session is for stakeholders only

Communications Alliance invites industry stakeholders to an information session on the status of work to implement the requirements of the Communications Legislation Amendment (Content Services) Act 2007.

The Content Services Act 2007 requires Code development to address each of the sections of the industry: hosting service providers, links service providers, live content service providers and commercial content service providers.

The forum affords a significant opportunity for stakeholders to learn about the development of the Internet Industry Association’s draft Content Services Code and revision to the Mobile Premium Services Industry Scheme [MPSIS].  There will also be a question and answer time.

As with all Communications Alliance events and activities, the objective is to facilitate productive information provision and dialogue amongst industry members who share the commitment to find industry solutions for industry issues.

Industry representatives from Mobile Carriage Service Providers, Content Service Providers, Content Aggregators, Content Developers, Hosting, Links, Live Content and Commercial Content Service Providers.

Telecommunications (Interception and Access) Amendment Act 2007: Industry Information Session

Communications Alliance is hosting an industry information session regarding the commencement of the Telecommunications (Interception and Access) Amendment Act 2007 (TIA Bill).

The Telecommunications (Interception and Access) Amendment Act 2007 (the Amendment Act) received the Royal Assent on Friday 28 September.   Schedule 1 to the Amendment Act which transfers the provisions from the Telecommunications Act 1997 to the Telecommunications (Interception and Access) Act 1979 will commence on 1 November 2007.

To assist stakeholders to be prepared for this date, Communications Alliance is hosting an industry information session.  The aim of this session is to advise stakeholders of changes to the telecommunications access regime on commencement of Schedules 1 and 2 and provide a forum to discuss any issues that participants may have.  The session will cover the amendments which will commence on the date of Assent (contained in Schedule 2 of the Bill), but will focus mainly on the new requirements arising out of Schedule 1, including:

  • the new processes for the access to telecommunications data (on either an historical or prospective basis);
  • new administrative measures which will need to be in place relating to the authorisations of telecommunications data, as well as notifications, revocations of authorisations and other measures;
  • new reporting requirements introduced by the Bill; and
  • the transfer of provisions relating to industry co-operation.

The session will be addressed by representatives from the Attorney-General's Department.

About the Event
The Communications Consumer Dialogue will be an interactive forum; designed to establish a dialogue between the audience and speakers. The Consumer Dialogue will focus on how Australia will achieve equitable access and is intended to be forward-looking, with a view to the opportunities which future technologies present for all consumers.

The expertise of Jenny Brockie in facilitating and moderating group interactions will ensure that the Consumer Dialogue is an inter-active and energetic dialogue between all participants - panel members, attendees and moderator.

Communications Alliance held an industry forum to discuss the application of the Universal Service Obligation (USO) in greenfield areas.  

The Minister for Communications, Information Technology and the Arts, Senator the Hon Helen Coonan, called for public submissions as part of a review of the telecommunications Universal Service Obligation (USO).

Background:
In an address to the National Press Club on 27 June, Senator Helen Coonan announced the commencement of a review of the USO. 

'…this review will look at the obligations on industry and determine whether the load is being shared equitably as was its intention.

Unlike some jurisdictions, such as the UK, all telecommunications carriers in Australia are required to make a proportionate contribution, based on market share, towards the cost of providing the USO.
Telstra has argued that the amount its competitors contribute to the USO does not reflect their costs incurred providing the obligation.

This USO Review will test this argument and inform my decision on setting the next round of USO subsidy levels.

The USO review will also consider whether it is appropriate for Telstra to be the USO provider in all circumstances.

For example, should Telstra be required to be the Universal Service Provider in a greenfield estate where another company wins the development contract to be the infrastructure provider for that estate?

Or should the company that wins that contract also bear the responsibility for the provision of a telephone service in that estate?

A discussion paper for public comment on the USO Review will be released shortly.

The initial proposal is for this forum to discuss and consider greenfields estate issues in general. If the USO Review Discussion Paper is released prior to this date, the forum may consider the wider issues of the USO. 

No definite timing is available on the release of the discussion paper, however The Australian, August 07, 2007 reported: "Senator Coonan next week plans to announce a review of the Universal Service Obligation..."

At the Communications Alliance members' forum 'FTTN Technical Issues in Wholesale Arrangements' held on 28 March 2007 it was agreed that Communications Alliance would create 2 work streams for industry to address issues raised and discussed at the forum: 

  1. technical and operational matters for transitioning to and operating in an FTTN environment;
  2. commercial principles for wholesale access arrangements in an FTTN environment.

Communications Alliance invites its members to nominate a representative to attend a roundtable meeting to progress the work on commercial principles for wholesale access arrangements in an FTTN environment.  We encourage you to consider nominating your commercial/regulatory managers to this important event.

An agenda and background papers will be provided before the roundtable. 

As with all Communications Alliance events and activities, the objective is to facilitate information provision and dialogue amongst industry members who share the commitment to driving industry solutions for industry issues.

Important opportunity to have a voice!

The ACCC is currently conducting 2 inquiries in respect of the following papers:

  • Fixed Services Review: A second position paper (submissions due 30 June);
  • ULLS: An ACCC Discussion Paper examining possible variation of the service declaration for the unconditioned local loop service (submissions due 15 June).

Communications Alliance will host an industry briefing on the 1st June 2007 where the ACCC will present key aspects of the inquiries and industry will have the opportunity for initial questions and comments.

Communications Alliance provides opportunity for input to inquiry
Communications Alliance is aware that there are differing perspectives on these issues and that many industry participants will be lodging their own submissions.  Communications Alliance will assist participants who do not intend to lodge individual submissions but would like their views to be conveyed to the inquiries by acting as a conduit for comments.  A single document collating all such views will be prepared and submitted to the inquiries. Communications Alliance presents industry briefing by the ACCC following their discussion paper Broadband Internet Speed Claims and the Trade Practices Act 1974 issued in January 2007.

- NGN Industry Consultation Meeting

Communications Alliance, AMTA and the IIA are jointly hosting a meeting to facilitate consultation with industry by Access Economics on the policy, regulatory and wider implications of NGNs for Australia.

Access Economics was selected by the Department of Communications, Information Technology and the Arts (DCITA) to conduct a major consultancy on next generation networks (NGNs).  The consultancy is to be completed by the end of June 2007. 

Access Economics will outline the consultancy and hear industry comment on the implications of NGNs for Australia and the industry.  The meeting will concentrate on options for future communications services and networks rather than the technical details of NGNs. 

This meeting provides a significant opportunity for industry to provide early input into future reviews of communications policy and attendance is encouraged.
