Commenting on the Department of Justice & Regulation Crimes Amendment Bill 2015

Communications Alliance has provided a recent submission on a draft Crimes Amendment (Child Pornography and Other Matters) Bill 2015 proposal by the Department of Justice & Regulation Victoria.

The Bill aims to make the investigation and prosecution of child pornography offences in Victoria more effective, including offences dealing with:

  • the administration of a child pornography website;
  • encouraging a person to use a website to deal with child pornography; and
  • providing assistance to another person about avoiding apprehension for a child pornography offence.

Industry have noted that whilst they do not oppose the intent of the proposed legislation, it would appear more efficient to address any perceived gaps in the existing Commonwealth legislation and that if necessary, the proposal would appear to be of a national benefit rather than just state level.

Industry also wished to ensure that ISPs are not captured in the definition of ‘administer’ which includes the maintenance of a website.
